Terms of Service

1. Who may use the Services

You must be at least 18 years old and able to form a binding contract. The course is designed for parents and guardians to use with their children. A child may use the lessons only under the supervision of the adult who holds the account, and that adult is responsible for the child’s use.

2. What we provide

ZookEd is an online video course that helps students in kindergarten through second grade build the reasoning skills covered by the Cognitive Abilities Test (CogAT®). The course consists of video lessons and short self-check tests, delivered through our course platform (the “Course”).

We also offer, by request, (a) a printed CogAT practice book for your child’s grade level, mailed to you (the “Printed Book”), and (b) live online classes led by David Zook: nine 45-minute classes, two per week (about one month in total), in small groups of up to 5 children, held live on Zoom (the “Classes”). Classes are not recorded. New Class groups form at the end of each month for the following month, and a paid Class series goes ahead even if your group has only one child.

3. Prices, payment, and delivery

Course.

• The Course costs $150 (USD), charged once at checkout. It is not a subscription and does not renew automatically.
• Your purchase gives you 90 days of access starting from the date of purchase. When the 90 days end, access to the Course ends.

Printed Book.

• The Printed Book costs $49 (USD) plus shipping. You request it on our website; we calculate shipping for your mailing address and email you a secure Stripe payment link for the total ($49 plus shipping and applicable sales tax). Shipping is paid by you.
• We mail the book that matches your child’s grade level. Delivery is within 2 weeks of payment, to addresses in the United States.

Classes.

• The Classes cost $775 (USD) for the full series of nine classes. You request a spot on our website; we email you the details of the next group and a secure Stripe payment link. Your spot is reserved once payment is received. Classes run on Zoom and are not recorded.

For everything.

• Payment is processed by Stripe. You authorize us to charge the payment method you provide. Applicable taxes, if any, are shown at checkout or on the payment link.
• We may change prices for future purchases at any time; a change does not affect a purchase already made.

4. Refunds

The Course carries a 90-day money-back guarantee: if your child completes it and the CogAT results come in below the school district’s threshold, you can get your money back under the conditions in the Refund Policy. Printed Books and Classes are not refundable, except as stated in the Refund Policy. See the Refund Policy for details and how to make a request.

5. Your account and license

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable license to view the Course for your own household’s non-commercial educational use during your access period. You must keep your login credentials confidential and are responsible for activity under your account. One account may be used by one household; do not share your login.

6. Acceptable use

You agree not to: copy, record, download, screen-capture, photograph, republish, resell, or distribute any Course, Printed Book, or Class material (including by recording a live Class); share or transfer your account; use the Course to run a tutoring or commercial service; attempt to bypass access controls or interfere with the Services; or use the Services unlawfully.

7. Intellectual property

The Course, the Printed Book, and the Classes, including their videos, lessons, questions, images, text, and branding, is owned by Big Brains Education or its licensors and protected by copyright and other laws. Except for the limited license in Section 5, no rights are transferred to you.

8. No affiliation with test publishers

CogAT® is a registered trademark of Riverside Insights. ZookEd is an independent test-preparation provider and is not affiliated with, sponsored by, or endorsed by Riverside Insights or any school district.

9. No guarantee of results

The Course, the Printed Book, and the Classes are educational and designed to help students become familiar with the kinds of reasoning tasks that appear on the CogAT. We do not guarantee any test score, percentile, placement, program eligibility, or admission. Results depend on many factors outside our control, including the child’s development and effort, the test administered, and each school district’s own criteria and decisions. The Course’s 90-day money-back guarantee, described in the Refund Policy, is a refund offer only and is not a promise of any result.

10. Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Services will be uninterrupted or error-free.

11. Limitation of liability

To the fullest extent permitted by law, Big Brains Education and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or opportunities. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the product or service the claim relates to. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Suspension and termination

We may suspend or end your access if you breach these Terms. If we end your access for a reason other than your breach, we will refund the unused portion of your purchase price on a pro-rata basis.

13. Governing law and disputes

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Before filing a claim, please contact us at prepcogat@gmail.com so we can try to resolve the issue informally. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in King County, Washington, and you consent to their jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time. The “Effective date” above shows the latest version. Continuing to use the Services after a change means you accept the updated Terms; changes do not apply retroactively to purchases already made.
